Terms:

The above prices are NETT and exclusive of VAT at the current ruling rate.
Credit facilities are subject to suitability and satisfactory credit status.

Terms of Payment:

Unless agreed otherwise in writing, the due date for full payment is 30 days from date of invoice.
The company reserves the right to charge compound interest on overdue accounts. Rates of interest will be charged at Bank of England base rate plus 8%.
Failure to make payment in full by the due date may result in immediate suspension of performance, and any amounts outstanding may be recovered as debt.
Goods held in stock beyond the programmed delivery or installation date shall be paid for as if delivery has been made at that time. The company reserves the right to make an additional charge of bank base rate plus 8% per month of the value of goods held in stock, as calculated by the company, beyond that date.
Notwithstanding passing of risk in the goods, the title in the goods shall not pass to the customer until the company has been paid in full for the goods.
Should you be in breach of the credit terms offered. Tayban accepts no liability with regards to delays to contract programmes, follow in trades, liquidated damages etc...

Retention:

Tayban Concrete Products (2010) Ltd provide an undertaking to return to the project to repair, refix or replace any goods from Tayban Concrete Products (2010) Ltd, should any problem arise from their own fault, caused by design, manufacture or installation but excluding returning to site to rectify faults, damage or changes done by others without our written consent.
In consideration of this undertaking the customer agrees to waive any retention from the contract payments.

Further in consideration of the Employer / Customer entering into the Contract with Tayban Concrete Products (2010) Ltd, they hereby guarantee to the Employer / Customer the due obligations in or arising from the Contract in respect of retention.

The obligations to Tayban Concrete Products (2010) Ltd under this undertaking shall be released and discharged absolutely upon the date of issue of the Certificate of Practical Completion pursuant to the Contract.
The obligations of the undertaking will become void if the Employer / Customer breach the Housing Grants, Construction and Regeneration Act 1996.

This undertaking shall not confer any benefit upon and no terms thereof shall be enforceable by any person under, or by virtue of, the Contracts (Rights of Third Parties) Act 1999.

This undertaking shall be treated in a manner similar to a deed and shall be governed by and construed in accordance with English law.

Our definition of completion shall be the date that our Contract Manager issues a “Completion of Contract Sheet” and/or “Part Phase Hand over Sheet” to the Main Contractor.*

Acceptance of This Quotation:

This quotation is valid for a period of 30 days from the date of this letter. After 30 days, please contact our estimating department for current status of this quotation, due to highly volatile price changes in reinforcement.
This quotation is an invitation to negotiate terms. No contract exists (nor shall be deemed to exist) and it does not constitute an offer to supply until Tayban accepts an order received by you for the purchase of goods mentioned in this quotation.
This quotation is based on the specification of your requirements supplied by you and Tayban reserves the right to increase its quotation if your specification is subsequently varied.
All information in this quotation is strictly confidential to Tayban and is disclosed to you for evaluation purpose only. You agree not to disclose this confidential information in whole or part save for your purposes of your evaluation of the quotation.

  3. This quotation is based on information supplied and may include assumptions made due to incomplete information. We therefore reserve the right to amend the quotation should these assumptions be incorrect or impractical caused by subsequent investigations.
  4. In the time scale available to prepare this quotation we have been unable to visit site to ascertain conditions. We therefore reserve the right to amend this quotation in the event of issues arising from any subsequent site visit.
  5. Floors should normally be fully grouted before being subjected to load, unless the structural design requirements allow them to be left un-grouted. Tayban Concrete Products (2010) Ltd in conjunction with the Structural Engineer will confirm the requirements. Where grouting is required, the customer should ensure that this is carried out prior to loading.
  6. As Tayban Concrete Products (2010) Ltd undertake to comply with requirements to the project specification, they do not accept responsibility in ensuring that these specifications comply with any specific building control or any other statutory regulations.
  7. Concreting, grouting or mortar infill at lifting sockets, tolerance joints (including floor unit installation tolerances) and where other in-situ concrete make up areas are deemed necessary, shall be carried out by the customer.
  8. The taking of site dimensions, setting out or checking/settings of level of the structure, provision and placement of supports including levels are not included in this quotation.
  9. Cast in holes may be formed during fabrication where structurally acceptable, and are a chargeable item subject to re-measure on completion – see note 12. These holes will either be square or rectangular and their minimum dimension will not be less than the slab thickness. Making good holes after placement of services is by others. Smaller holes than this are to be site drilled centrally through the cores by others after consulting with Tayban Concrete Products (2010) Ltd.
  10. Larger holes may only be possible using hanger brackets to support adjacent slabs. These are chargeable and are subject to final design confirmation – see note 12.
  11. We can give no guarantee that holes not detailed in the tender documents can in fact be incorporated in our floor system.
  12. The following factory formed items will be charged as re-measurable extras on completion:-

  13. Finishes should be designed with due consideration of differences in levels, owing to camber, and/or variations in level as a result of changes of span. These levelling finishes are to be provided and laid by customer.
  14. The customer is to supply any permanent and/or temporary shuttering and place any in-situ concrete infill as indicated on Tayban Concrete Products (2010) Ltd drawings.
  15. Restraints straps supplied and installed by others.
  16. Concrete surface to the soffit of Wide Slab floor units is an “as from mould finish” Type “A” Finish as described in clause 6.2.7.3 of B.S.8110: part 1 1997. Top surface to Wide Slab floor units will be formed using a “float” finish.
  17. Concrete surface to the soffit of Precast Stairs (including soffits, risers and side strings only) and Precast Landings (including soffit and sides only) is an “as from mould finish” Type “A” Finish as described in clause 6.2.7.3 of B.S.8110: part 1 1997.
  18. Where units are on a shared and reduced bearing situation i.e. a 140mm wall, it is the customer’s responsibility to provide a temporary end bearing propping system.
  19. Due to Tayban’s method of manufacture, Precast Stairflights will have flat soffits. No downward projections from soffit line are permissible.
  20. This quotation does not include for forming balustrade pockets. Should these pockets be required they be site drilled by others.
  21. Unless specifically stated otherwise we have allowed for the staircases to be fixed alongside the floor slabs which they access, on the same visit/day. If this cannot be achieved, the customer will be charged accordingly for additional visits/days.
  22. Please note that in the case of external Precast Staircases, it is the customer’s responsibility to apply a non-slip finish/material to the final surface of the staircase after erection. Precast concrete stair treads and landing surfaces may not be suitable in locations where they are exposed to the climatic elements, raising the potential for slips and falls due to wetting, freezing etc,
  23. All items included in this quotation are to be taken as one complete package. Should the customer only be interested in part of this package, please contact our estimating department for a re-quotation.
  24. If you require Tayban Concrete Products (2010) Ltd to provide Passive Fall Protection eg. Netting. This will be charged at P.O.A

Lump Sum/Re-Measure:

This quotation is on a strict fixed priced re-measure basis, and has been prepared from drawings sent to us in your enquiry. Lump Sum contracts will only be entered into once construction issue drawings are in our possession and quantities have been verified.

Passive Fall Protection:

The following conditions must be complied with to ensure safe installation is achieved:

Where Air Mats are provided:-

  1. All rooms must be cleared of building materials, debris, props etc. These could interfere or prevent the effective placement and operations of the Air Mats.
  2. Ensure all floors are level and free from any sharp projections which may cause damage.
  3. All openings are to be protected by the Main Contractor.

All Passive Fall equipment hired through Tayban Concrete Products (2010) Ltd relates only to the footprint of the building and is subject to the Terms & Conditions of the sub-contract Hire Company (copy available on request) including the Main Contractors responsibility to reimburse costs for loss or damage of equipment by any party or cause (other than through negligence of Tayban Concrete Products (2010) Ltd personnel or their agents whilst on site)
When Passive Fall equipment is provided by others, the contractor is responsible to ensure that the equipment complies with current regulations and Tayban reserves the right to abort or suspend any visits should the safety of our personnel be in question.
Any violation of the above conditions will result in extra precautions being put in to place and all extra charges being forwarded to the customer.

Health & Safety

In addition to passive fall protection for workers at heights we require the following to be provided free of charge by the customer:

  1. External Scaffolding
  2. A designated external access platform for each major floor zone at all levels.
  3. Perimeter edge protection, including internal perimeters – i.e. stairwells etc
  4. The protection of all window and door openings is the responsibility of the Main Contractor.
  5. Perimeter passive fall edge protection during offloading of delivery trailers.

Failure to comply with all of the above as agreed in detail at pre-contract meetings will result in installation being suspended until the above is in order and any abortive costs will be forwarded to the customer.
We require a copy of the Health & Safety Plan for this project in accordance with ‘Construction (Design Management) Regulations’ – (CDM), particularly where it affects our products and/or operations. We also require the ‘named’ confirmation and details of your Project Planning Supervisor for our records. The named person is deemed to have already ensured that the programme meets all Health & Safety provisions and installation practicalities as they relate to the erection and performance of the Precast elements for both temporary and permanent works.

Installation:

Our tender allows the following due to the absence of full details regarding access to site.

This is accepted as sufficient on acceptance of our quotation:

Our tender estimates a crane size as specified in the quotation. Should site conditions necessitate a larger crane this will be charged as an extra. Should your site programme any additional visits, this also is charged as an extra. This must all be agreed with the customer prior to commencement of works.

Installation is based on:-

  • Unrestricted access to within 3 metres of the structure along all elevations.
  • To allow access of a crane (weight in tonnes specified in quotation)
  • To allow access to delivery vehicle and for the vehicle to move freely into position on suitable made up roads, for unobstructed hoisting of Precast units into position from above.

It is the responsibility of the Main Contractors to:-

  • Provide adequate hard standing for all mobile crane positions
  • Steel purlins and other obstructing steelwork must be left off or removed at no cost to Tayban Concrete Products (2010) Ltd until the floors have been fixed.

Tayban Concrete Products (2010) Ltd holds no responsibility for any damages to purlins, rails or bracing which have not been removed.

Working Hours:

Unless stated otherwise, our quotation is based on goods being delivered and installed during normal working hours i.e. Monday-Friday 8.00am to 16.30pm. This excludes statutory holidays and production facility shutdowns (Christmas period). Deliveries and installation required out of the stated times and days, will incur extra costs and will be charged to the customer.

Cancellations:

Please note that prior to Tayban Concrete Products (2010) Ltd commencement date for delivery/installation, our Contracts Manager may visit site to assess the suitability of the on-site conditions and structure. Should it be found that the works are incomplete or inaccessible, Tayban Concrete Products (2010) Ltd reserves the right to postpone any delivery/installation until written confirmation is received that works are complete and any obstacles have been removed before programming an alternative date. Any additional costs incurred will be the responsibility of the customer.
These additional costs can be avoided if written confirmation of a cancellation is received from the customer 5 days prior to our commencement date on site.

Delays due to adverse weather conditions:

Tayban Concrete Products (2010) Ltd reserves the right to postpone the installation of any floors and/or stairs due to adverse weather conditions, without liability for costs or delay disruption. Adverse weather conditions include:-

  • Mean wind speeds, including gusts of 20m.p.h or more as forecast by the Meteorological Office affecting mobile cranes.
  • Predicted flooding or standing water which may affect transportation and safe installation.

Stock Held:

Should your units be manufactured and stored on Tayban Concrete Products (2010) Ltd premises for period of time, lasting longer than 7 days past the original agreed delivery date then storage charges of £150.00 per week will be incurred.

Risk and Property:

Risk of damage or loss of the goods shall pass to the customer:

a. In the case of goods collected by the customer, at the time the customer or his agent signs a delivery receipt; or
b. In the case of goods delivered by the company, at the time of delivery.

Until such times as title of the goods passes from the company to the customer, the company, at its sole discretion, may enter upon any premises owned, occupied or controlled by the customer where goods are situated and repossess the goods.

The customer shall not pledge or charge by way of security for any indebtedness any of the goods which are the property of the company. Without prejudice to the other rights of the company, if the customer does so, all sums whatever owing by the customer to the company shall forthwith become due and payable as a debt.

Delivery:

Our quotation includes deliveries to site on articulated trailers in economic loads. A maximum of 2 hours is allowed for off-load of each trailer from time of arrival. Waiting time beyond this 2 hour period, caused by others, will be charged at P.O.A per hour per trailer. Confirmation of delivery dates should be received at this office in writing 10 working days prior to your required date.
Any delayed or cancelled deliveries caused by the customer less than 5 working days prior to delivery may incur a cost of P.O.A per trailer per day.

Lead Times:

Please be aware that lead times can fluctuate and are subject to change at short notice. Please contact the office at the appropriate time to obtain current delivery dates.
